طالبت المحكمة الجنائية الدولية السلطات السودانية بإتاحة الوصول دون عائق إلى الوثائق ذات الصلة بالتحقيقات التي يجريها مدعيها العام بشأن الجرائم التي ارتكبت في دارفور.
بالإضافة إلى ضمان الاستجابة السريعة لجميع طلبات المساعدة المقدمة من المكتب إلى السلطات السودانية؛ واتخاذ إجراءات فورية لتسهيل الوجود الميداني المعزز للمكتب في الخرطوم.
بجانب إتاحة الوصول دون عائق إلى الشهود العاملين لدى الحكومة أو الذين كانوا يعملون لديها سابقا والشهود الأساسيين الآخرين.
أوضح التقرير السادس والثلاثون للمدعي العام للمحكمة الجنائية الدولية إلى مجلس الأمن التابع للأمم المتحدة عملا بقرار المجلس 1593 (2005)، أنه رغم التعهدات الواضحة التي قطعها أكبر أعضاء حكومة السودان على أنفسهم خلال زيارة المدعي العام في أغسطس 2022، كان تعاون السلطات السودانية مع مكتب المدعي العام كان تعاونا محدودا في هذه المجالات ذات الأولوية في الفترة المشمولة بهذا التقرير.
وطالب التقرير الذي حصلت عليه صوا الهامش، بإتاحة الوصول دون عائق إلى الوثائق ذات الصلة بالتحقيقات التي يجريها المكتب وضمان الاستجابة
السريعة لجميع طلبات المساعدة
فضلاً عن إتاحة الوصول دون عائق إلى الشهود العاملين لدى الحكومة أو الذين كانوا يعملون لديها سابقا والشهود الأساسيين الآخرين
وقال تقرير المحكمة الجنائية الدولية لمجلس الأمن الدولي، إنه برغم التعهدات المشجعة التي قطعتها قيادة حكومة السودان على نفسها في أغسطس 2022، فإن الوصول إلى المحفوظات الحكومية وإلى المسؤولين الحكوميين السابقين الذين يُرجح أن يساعدوا في التحقيقات في الحالة في دارفور ظل بابه موصدا خلال الفترة المشمولة بالتقرير.
اعتبر تنفيذ طلبات المساعدة جزءا مهما من خطط التحقيق الذي يجريه المدعي العام للمحكمة الجنائية، ويوفر فرصة أساسية لحكومة السودان لإظهار إرادة حقيقية للتعاون.
حدد المدعي العام، في تقريره الأخير، سلسلة من الأولويات المواضيعية التي من شأنها توجيه عمل المكتب عبر مسارات أنشطة التحقيق وجهود التعاون.
أردف أنه رغم تعاون حكومة السودان لم يكن مرضيا خلال الفترة المشمولة بالتقرير، فقد أحُرز تقدم حقيقي في المجالات المواضيعية الرئيسية من خلال التعامل مع المجتمعات المحلية المتضررة والمجني عليهم، وتقوية التواصل مع الشركاء الدوليين وتعزيز التعاون مع الدول الثالثة.
ولأجل المضي قدماً في الخطوات المهمة التي اتخذتها المحكمة، أكد التقرير علي أن تعاون السلطات السودانية الكامل يظل أمرا محوريا لتسريع أعمال التحقيق وبلوغ التوقعات المشروعة للناجين.
وأضاف زيارة المدعي العام إلى السودان في أغسطس 2022، ولا سيما زيارته إلى دارفور ومخيمات المشردين داخليا، وفرت منبرا هاماً للحوار وتعزيز التعاون مع المجتمعات المحلية.
وخلال زيارة المدعي العام، استمع مباشرة إلى المجني عليهم والمجتمعات المحلية المتضررة فيما يتعلق بتوقعاتهم المشروعة في إحقاق العدالة وكيف يمكن للمكتب أن يشارك بفعالية أكبر مع المتضررين من الجرائم المدعى بارتكابها في دارفور.
وخلال الفترة المشمولة بالتقرير، عقد المكتب أيضا أول مائدة مستديرة مواضيعية مع منظمات المجتمع المدني، كُرِّست لمعالجة الجرائم التي تستهدف الأطفال أو تؤثر عليهم. وتضمن ذلك مشاركة عدد من منظمات المجتمع المدني من دارفور.
